Investigations have commenced into the pricing practices of eight companies online, with an additional 100 businesses expected to receive warnings. The firms under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.
The Competition and Markets Authority (CMA) is focusing its investigations on how fees are displayed online, potential misrepresentation of time-limited offers, and the automatic inclusion of optional charges without customer consent. Specific concerns have been raised regarding additional charges imposed by StubHub and Viagogo on ticket purchases.
AA Driving School and BSM Driving School are being examined for their fee presentation methods on their websites, particularly regarding the clarity of these charges at the beginning of the purchasing process. Gold’s Gym is also facing scrutiny for the handling of a one-time joining fee for its annual membership, specifically for introducing it midway through the sign-up process.
Wayfair, Marks Electrical, and Appliances Direct are being investigated for various practices including time-limited sales, default opt-ins, and the use of additional fees. The CMA has indicated that these investigations are based on suspicions of potential breaches of consumer law, emphasizing that no final decisions have been reached.
These cases mark the initial applications of the CMA’s new consumer protection powers. The authority is sending letters to 100 additional businesses expressing concerns about their utilization of supplementary fees and sales strategies. CMA’s chief executive, Sarah Cardell, emphasized the importance of ensuring transparent pricing and fair dealing for consumers across various sectors, stating the commitment to take action against any illegal conduct detrimental to consumer interests.
Both AA Driving School and Viagogo have responded to the investigations, with AA Driving School affirming its compliance with transparency rules and willingness to enhance customer notifications. Viagogo has expressed cooperation with the CMA’s inquiries.
The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. It is noted that BSM Driving School is a subsidiary of the AA, while Viagogo and StubHub operate under the same parent company.
